The driver got behind the steering wheel of the vehicle, while the injured employee stood at the back of the vehicle. The driver starting backing the vehicle up and struck the employee's right leg, breaking it.

He was not able to get out of the way and was struck by the pallet and knocked to the ground. The employee fractured his right hip and right femur, requiring surgery and hospitalization.
